MINSTROY RF: STANDARD CONTRACTS FOR PROJECT DESIGN AND CONSTRUCTION ARE DEVELOPED

The Ministry of Construction of Russia has developed model contracts for construction and for design and survey work. The relevant draft departmental orders are published for public discussion on the regulation.gov.ru portal. This was announced by Deputy Head of the Ministry of Construction of Russia Hamit Mavliarov at a meeting with representatives of construction industry of the Tomsk, Omsk, Novosibirsk regions, Altai Territory and the Republic of Khakassia in Kemerovo.
According to the deputy minister, standard contracts will establish uniform rules for the interaction of state customers and contractors performing design and survey work, as well as construction or reconstruction of facilities.
“Repeated application of the developed contract will reduce the time and optimize the cost of construction of the facility,” said Khamit Mavliyarov.
Today, customers draw up contracts on their own. According to the document, from January 1, 2019, they will be required to conclude work contracts on the proposed form.
In standard contracts, in particular, the following will be indicated: the subject of the contract, its price and the procedure for paying for the work performed, the rights and obligations of the parties, the area of responsibility, and the timing of services. The process of ensuring the construction or reconstruction of an object with materials and equipment will also be spelled out, especially the contractor's involvement of third parties in the performance of work. In addition, the contracts indicate the procedure for acceptance of work, a schedule for eliminating deficiencies, the duration of the contract and the reasons for its termination.
